TERMS OF SERVICE

1. Acceptance of Terms

1.1. These Terms of Service (the “Terms”) govern your access to and use of any products, services, or facilities (collectively, the “Services”) provided by OTP Killian LLC (“Company”), in partnership with Killian Palms Country Club.

1.2. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you are prohibited from using the Services.

2. Mobile Messaging (SMS) Program

By opting in to receive SMS/MMS messages from OTP Killian LLC, you agree to the following:

Program Description: We send text messages to provide appointment confirmations, booking reminders, facility updates, and occasional promotional alerts.

Message Frequency: Message frequency varies based on your interactions with us.

Pricing: OTP Killian LLC does not charge for this service. However, message and data rates may apply from your mobile carrier.

Opt-Out: You can cancel the SMS service at any time. Just text STOP to our phone number. After you send "STOP," we will send a confirmation SMS and then no longer message you.

Carrier Liability: Mobile carriers are not liable for delayed or undelivered messages.

3. Eligibility

3.1. Adults: Individuals who are at least 18 years of age may reserve and use the Services.

3.2. Minors: Individuals under 18 may participate only if a parent or legal guardian signs a waiver and remains present to supervise at all times.

4. Reservation and Payment

4.1. Booking: Full payment is required at the time of booking to secure a reservation.

4.2. Late Arrival: Late arrival may result in reduced playing time or forfeiture of the reservation without refund.

5. Refund Policy

5.1. Cancellations and refunds are governed by our separate Refund Policy, which is incorporated herein by reference.

6. Assumption of Risk and Release of Liability

6.1. Risk: Participation in soccer involves inherent risks, including physical injury and property damage. By using the Services, you voluntarily assume all risks. 6.2. Release: To the fullest extent permitted by law, you release OTP Killian LLC and Killian Palms Country Club from any and all claims or liabilities arising out of your use of the Services.

7. Media Release

7.1. By entering the premises, you grant OTP Killian LLC the right to record your likeness for promotional and marketing purposes without compensation.

8. Governing Law

8.1. These Terms shall be governed by the laws of the State of Florida. Any disputes shall be brought exclusively in the courts located in Miami-Dade County, Florida.
